General Sales Terms and Conditions

The website www.ioconbio.com is owned by Azienda Agricola IoconBio S.S. di Falconio Stefano, headquartered at Via Duca degli Abruzzi, 111, 66047 Villa Santa Maria, fiscal code, registered with the Companies Register of Chieti, VAT number 02489060695, and is destined to retail sales of food products.

IoconBio complies with the legislation regarding distance contracts according to the article 50 of the Italian legislation and following the Legislative Decree 206/2005.

GENERAL CONDITIONS

All sales, delivery, and payment methods are described in several sections of the Website and are considered integral and substantial parts of this contract. The conditions applicable to each single order will be shown on the Website at the time of the order. Any new conditions will be effective upon publication on the Website and will apply only to following sales.

 

PUBLIC OFFER

All products and prices listed on the Website form a public offer under the limitations and conditions of the Website itself and in these general terms and conditions of sale.

 

PRODUCTS

The appearance of the delivered products may differ from the Website’s images if the producer changed the packaging, which is beyond IoconBio’s control.

 

VARIABLE WEIGHT PRODUCTS

Variable weight products (e.g., fruits, vegetables, meat, fish, deli and dairy products) are presented on the Website with approximate size and weight. The actual weight is determined only at the time of product preparation and may vary by up to 20% more or less than the approximate weight listed on the Website. Therefore, if your purchase includes one or more of these products, the weight and amount set at the time of order may differ from the actual weight and amount calculated at the time of receipt issuance. When purchasing variable weight products with a credit card, the amount charged at the time of order will include an additional 20% of the total amount of variable weight products. The exact amount will be communicated with the delivery document and charged to the credit card exclusively upon delivery.

 

PRICES

The Customer’s bill will exclusively have the price (per unit of measurement Euro/Kg for variable weight products and per package for all other products) calculated at the time of order, without price increases or decreases, including any promotions that may have occurred subsequently or previously concluded.

Shipping costs are calculated according to the products in the cart according to the table:

  • 1 to 3 products: 5 euro
  • 4 to 6 products: 6.5 euro
  • 7 to 12 products: 8 euro
  • from 13 to 17 products: 9,5 euro
  • from 18 products: free shipping
For Tomato Passata products (500, 720 gr.)
  • from 1 to 17 products: basic delivery + 1 euro
  • from 18 to 24 products: 14.5 euro
  • from 25 to 30 products: 17 euro
  • 31 to 35 products: 18.5 euro
  • from 36 products: free shipping

 

ORDER ACCEPTANCE

The order submitted by the Customer will be binding on IoconBio only if the entire ordering process has been completed without any error messages. IoconBio will not include products not expressly ordered by the Customer in the purchase, except for gifts.

 

ORDER CONFIRMATION

The Customer will receive an order confirmation in their email inbox, summarizing the products, prices, and the general and specific conditions of the order.

 

CANCELLATION AND MODIFICATION OF THE ORDER

IoconBio may cancel the order due to unforeseen logistical and organizational difficulties, and will notify the Customer via email. Alternatively, IoconBio may modify the delivery date and/or time upon prior agreement.

 

DELIVERY

IoconBio delivers only to areas pertained to the BRT.
Delivery times range from 24 to 72 hours, excluding SCS (Sardinia, Calabria and Sicily) and remote ZIP codes.
For any anomalies, customers may contact IoconBio directly using the contact information provided in the Contact Area of the website. IoconBio shall not be held responsible for any delays occurring during transport.

Similarly, IoconBio cannot be held responsible for any loss, damage, incorrect or failed delivery caused by events and/or acts of force majeure or unforeseen circumstances, including but not limited to: natural disasters, adverse weather conditions (such as heavy snowfall), strikes (by its own or other employees), transportation accidents, explosions, or any other similar or different causes.

 

PRODUCT AVAILABILITY AND PURCHASE RESTRICTIONS

IoconBio shall not be held responsible for the temporary or permanent unavailability of one or more products. In the event of unavailability, even temporarily, of requested products, IoconBio will not charge the Customer for the corresponding price. The conditions of purchase restrictions of individual products are provided by the website.

 

FAILED DELIVERY

The Customer or the appointed recipient must be present at the address and time specified in the order for delivery. If the Customer (or appointed person) is not present, a second delivery attempt will be made, and if unsuccessful, IoconBio will initiate a storage procedure. Failure to collect the order will result in IoconBio not refunding the delivery cost or the cost of the products. Additionally, IoconBio reserves the right to exclude the Customer from the service.

In the payment reference, please specify the order number provided in the order summary email. To speed up the delivery, you can email the receipt of the bank transfer to info@ioconbio.com.

 

PAYPAL

By selecting this payment method, you will be redirected to a PayPal page where you can enter your personal email address and password for your PayPal account, or proceed to create a new PayPal account. Following the registration procedure, you can proceed with PayPal payments without re-entering your information for future purchases. Choosing this payment method charges the amount directly to your PayPal account. PayPal safeguards buyer information.

For each transaction using this method, PayPal will send a confirmation email. The order amount is charged to your PayPal account upon order acquisition. In case of cancellation, the amount is refunded to the customer’s PayPal account.

Payments are accepted exclusively from users registered on the Italian PayPal website.

RIGHT OF WITHDRAWAL

The Customer’s rights are stated by Legislative Decree 206/2005.
Therefore, the Customer has the right to withdraw from the contract, entirely or partly, without explanation and without incurring any costs, provided that the withdrawal is communicated by registered letter with return receipt to Azienda Agricola IoconBio S.S. di Falconio Stefano, Via Duca Degli Abruzzi, 111, 66047 Villa Santa Maria CH, within 10 working days from the day of receiving the products. The communication can also be sent in advance, within the same timeframe, via email, fax, or Telegram, provided that it is confirmed by registered letter with return receipt within 48 hours thereafter. This communication must specify the intention to withdraw from the purchase and the product(s) for which the right of withdrawal is being exercised, along with a copy of the invoice.
If the delivery has already taken place, the consumer must return the products they intend to return, at their own expense, to the same address mentioned above within ten working days from the date they received the products, with the words “order return” clearly marked on the package. The acceptance by the post office or courier will be considered as proof of compliance with the deadline. Parcels paid on delivery or with assigned postage will not be accepted under any circumstances. The Customer must therefore return the product at their own expense according to the following methods:
If the right of withdrawal is exercised in accordance with the procedures described, IoconBio will reimburse the amount paid for the purchase of the product as soon as possible and in any case within 30 days from the date IoconBio becomes aware of the Customer’s exercise of the right of withdrawal.
However, if the products do not have the promised essential characteristics, present manufacturing defects, errors in the delivery, or are otherwise attributable to IoconBio, the shipping costs for the delivery of the purchased products and any cash on delivery charges will also be refunded.
The right of withdrawal is not allowed in the following cases:

  1. a) purchase of sealed packaged products opened by the Customer;
  2. b) goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly (e.g., fresh and perishable food products);

 

RESPONSIBILITY

IoconBio guarantees compliance with the quality standards and certifications related to products only until the moment of delivery to the location specified by the Customer. IoconBio disclaims any responsibility for the deterioration of products due to improper storage after delivery. IoconBio is not liable for any inaccuracies, technical errors, or other information contained on the Website.

IoconBio disclaims all liability for direct or indirect damages of any kind or form arising from the use of the Website and/or the information, photos, and content therein, including delivery inside the Customer’s home upon request. IoconBio assumes no responsibility for information provided/acquired from individual producers or distributors.

 

PRIVACY

IoconBio will process Customer’s personal data in accordance with privacy regulations, as shown in the Privacy section.

 

FORO COMPETENTE

Any dispute arising from the application, interpretation, and execution of these general terms and conditions of sale will be exclusively referred to the court of the consumer’s place of residence or domicile, if located within the territory of the State.
